Ariz. Admin. Code § R9-7-301 - Ownership, Control, or Transfer of Radioactive Material
A. In addition to the requirements of this
Article, all licensees are subject to the requirements of 9 A.A.C. 7, Article
1, Article 4, and Article 10. Licensees engaged in industrial radiographic
operations are subject to the requirements of 9 A.A.C. 7, Article 5; licensees
using radioactive material in the practice of medicine are subject to the
requirements of 9 A.A.C. 7, Article 7; licensees transporting radioactive
material are subject to the requirements contained in 9 A.A.C. 7, Article 15;
and licensees using radioactive material in well logging operations are subject
to the requirements in 9 A.A.C. 7, Article 17.
B. Notwithstanding any other provisions of
this Article, any person may own radioactive material, provided that the
ownership does not include the actual possession, custody, use, or physical
transfer of radioactive material or the manufacture or production of any
article that contains radioactive material without the applicable
certification, license, or registration.
C. A manufacturer, processor, or producer of
any equipment, device, commodity, or other product that contains source
material or radioactive material whose subsequent possession, use, transfer, or
disposal by all other persons is exempt from regulatory requirements may only
obtain authority to transfer possession or control of the material from the
U.S. Nuclear Regulatory Commission, Washington, D.C. 20555.
