items 13 and 14 of paragraph (a) of this section if the words "livery vessel"
are plainly marked on the certiflcate.
§ 174.123
Annual report of
numbered vessels.
Before March 1 of each year, each State that has an approved
numbering system must prepare and submit Coast Guard Form CGHQ-S923. Report of
Certificates of Number Issued to Boats, to the Coast Guard, g 174.125 Coast
Guard address.
The report required by S 174.123 must, be sent to U.S. Coast Gum
(OBD/62) . 400 Seventh Street SW., Washington, DC 20590.
Effective date. These amendments are eflectlye on July 1,1973.

Subpart A-^General
§ 174.1 Applicability.
This part establishes a standard numbering system for vessels
find a unifoiro vessel casualty reporting system for v^-Eels by
prescribing requirements applicable to the States for the approval
of
State numbering systems.
§ 174.3 Dcfinilions.
As used In this part:
(a)
"Act" means the Federal Boat Safety Act of 1971 (85 Stat.
213; 46 U.S.C.
1451.
et seq.).

"Operator" means Uie person who! is in control or in charge of a vess^ while it
is in use. '
(b) No person may use
a recreational boat 16 feet or more in length, except
a canoe or
kayak, unless at least one

(1) Type I PFD.
(2) Type U PPD.

(c) No person may use a
recreational boat 16 feet or more in length, except a canoe or kayak, unless at

Exceptions.
(a) A person using a canoe or
kayak that is enclosed by a deck and spray skirt need not comply with §
175.15(a) if he wears a Vest-^type lifes^Ving device that-
(1) Has no Ifess than 150 separate
permanently inflated alt sacs made of not less than 12,mil polyvlnylchloride
film and has not less
than 13 lioxinds of
positive buoyancy In fresh water. If worn by a person who weighs more than 90
pounds; or
(2) Has no less than 120
separate permanently inflated air sacs made of. not less than 12 nfll

§ 173.79 Expiration of Coast Guard
certificate of number.
A certificate of number issued by the Coast Guard expires 3 years
from the date it is issued.
§
173.81 Coast Guard forms for pum-bering and casnaltj' reporting.
(a) In a State where the Coast Guard is the
issuing authority, the following Coast Guard forms must be used:
(1) Each application for a certificate of
number or renewal must be made on two-part Form OG-3876 and 3876A, Application
for Number and Temporary -Certificate.
(2) Each notification required by §
173.29(b) must be made on Form CG-2921, Notification of Change In Status of
Vessel. I
(3) Each
notification required by ' § 173.29(a) must be made on Form CG-3920,
Change of Address Notice.
(4) Each
notification required by 5 173.29(c) must be made in writing.
(5) Each application for a duplicate ;
certificate of number must be made on two-part Form CG-3919 and CG-3919A,

(b) The fee required by the issuing
authority, 11 any.

173.75 Temporary certificate
A temporary certificate valid for not more than 60 days after It
Is Issued may be issued by an Issuing authority pending the issue of a
certificate of number. A ' temporary certificate Is not valid after ' the date
that the owner receives the certlflcate oE number from the issuing
authority.
§ 173.77
Validity of cerlificale of number.
(a) Except
as provided in paragraphs ; (b), (c), (d), and (e) of this section, a j
certificate of number Is valid until the date of expiration prescribed
by the Is- ! suing authority.
(b) A certificate of number Issued by an
Issuing authority is invalid after the
' date upon which-
(1)
The vessel is documented or re-! quired to be documented under Part 67 of Title
46. Code of Federal Regulations;
(2) The person whose name appears on the
certificate of nimiber as owner of the. vessel transfers all of his ownership
in
the vessel; or
(3) The vessel Is destroyed or
abandoned.
(c) A
certificate of number Issued by an Issuing authority
Is Invalid
if-
(1) The application Tor the certificate
of number contains a false or fraudulent statement; or
(2) The fees for the issuance of the
certificate of number are not paid.
(d) A certificate of number Is invalid 60
days after the day on which the ves-.sel Is no longer principally used in the
State where the certificate was Issued.
(p) The type and amount of each fire
extinguisher used.
(q) The nature
and extent of each Injury.
(r) . A
description of all property damage and vessel damage with an estimate of the
cost of all repairs.
(s) A
description of each equli›nent failure that caused or contributed to
the
cause of the casualty.
(t) A description of the vessel casualty or
accident.
(u) The type of vessel
operation (cruising, drifting, fishing, hunting, skiing, racing, or other), and
the type of accident (capsizing, sinking, fire, or explosion or
other).
(v) The opinion of the
person making the

required hand portable fire extinguishers and semlportable fire ex-tingulslijng
syRtems are of the "B" type; I.e., suitable for extinguishing fires in-volviLng
flammable liquids, greases, etc.

start with "I" lor the smallest to "V" for the largest. For the purpose of
tills subchapter, only sizes I through III will bo considered. Sizes I and n
are considered hand portable fire extinguishers and sizes m, IV, and V are

shall have permanently attached thereto a metallic name plate giving the name
of the item, the rated capacity in gallons, quarts, or po'inds, the name and
address of the person or firm for whom approved, and the Identifying mark of
the actual manufacturer,
(e)
Vaporizing-llqiud type fire extinguishers containing carbon tetrachloride or
chlorobromomethane or other toxic vaporizing liquids are not acceptable as
equipment required by this subchapter.
(f) Hand portable or semlportable
extinguishers which are required
on. their name plates to be
protected from freezing shall not be located where freezing temperatures may be
expected.
(4) A person disappears from the
ves-, sel under circumstances that Indicate ^ death or Injury.
(b) A report required by this section must be
made-
(1) Within 48 hours of the occurrence If
a person dies within 24 hours oS
the
occiurence;
(2) Within 48 hours of
the occurrence If a person loses consciousness or receives medical treatment or
is disabled for more ^ than 24 hours or disappears from a ves- ' sel;
and
(3) TS^thin 5 days of the
occurrence or death If an earlier report is not required by this
paragraph.
(c) When the
operator of a Vessel cannot submit the casualty or accident report required by

173.57 Casualty or accident report.
Each report required by ! 173.55 must ! be in writing, dated upon
completion, and signed by the person who prepared It and must contain, if
available, at least the following information about the casualty ; or
accident:
(a) The numbers and names of
each vessel involved.
(b) The name
and address of each owner of each vessel Involved.
(c) The name of the nearest city or town, the
county, the State, and the body of water.
(d) The time and date the casualty or
accident occurred.
(e) The location
on the water.
(f) The visibility,
weather, and water conditions.
(g)
The estimated air and water temperatures.
(h) The name, addi-ess, age, or date of
birth, teleph(nie number, vessel operating experience, and boating safety
training of the operator making the
[ report,
(i)
The name and address of each operator of each vessel Involved.
(j) The number of persons on board or towed
on sklls by each vessel.
(k) The
name, address, and date of birth of each person Injured or killed.
(j) The cause of each death.
(m) Weather forecasts available to, and
weather reports used by, the operator before and during the use of the vessel.
(n) The name and address of each I
owner of property Involved.
(o) The
availability and use of per-I Eonal flotation devices.

§ 173.51
Applicability.
a) This subpart applies to
each ves-sel used on waters subject to the Jurlsdlc- i tion of the United
States and on the high I seas beyond the territorial seas for vessels owned in
the United States that-
(1) Is used by Its
operator for recrea- \ tlonal purposes; or
(2) Is required to be numbered under i this
part. ;
(b) This subpart
does not apply to a vessel required to have a certificate of j Inspection under
Chapter I of TiUe 46, Code of Federal Regulations. !
§ 173.53 Immediate notificalion of
dcatli or disappearance.
(a) When, as a result
of an occurrence that Involves a vessel or its equipment, a person dies or
disappears from a vessel, the operator shall, without delay, by the, quickest
means available, notify the i nearest reporting authority listed in Appendix A
of tilis part of-
(1) The date, time, and
exact location of the occurrence;
(2) The name of each person who died or
disappeared:
(3) The number and
name of the vessel; and
(4) The
names and addresses of the owner and operator.
(b) When the operator of a vessel cannot give
ttie
notice required by paragraph (a) of this
section, each person on board the vessel diall notify ttie casualty reporting
authority or determine that the notice has been given.

extinguishers manufactured after January 1, 1965, be corried on board
motorhoots or other vessels as required equipment.

paragraph (a) of this section and have a space or hyphen that Is
equal to the width of a letter other than "I" or a number other
than "1" between the suffix and the number. (Example: DC 6678 EP 1 or
DC-5678~EF~1.)
§
173.29 NvliAcation to itisuiiig

A
person whose name appears as the
owner of a vessel on a certificate of ntunber shall,
within 15 days, notify the issuing authority in a manner prescribed by the
issuing authority of-
(a) Any change
in his address;
(b) The theft or
recovery of the vessel:
(c) The
loss or destruction of a valid certificate of number;
(d) The transfer of all or part of his
interest in the vessel; and
(e) The
destruction or abandoimicnt of the vessel.
§ 173.31 Surrender of cerlificnie of
ntunber.
A person whose name appears as the owner of a vessel on a
certificate of number shall surrender the certificate In a manner
prescribed by the issuing authority within 15 days after it becomes Invalid
under paragraph (b), (c), (d), or (e) of 9 173.77.
§ 173.33 Kcmovalof number.
The person whose name appears on a certificate of
number as the owner of a vessel shall remove the number and validation sticker
from the vessel when-
(a) The vessel is
documented by the Coast Guard;
(b)
The certificate of number is Invalid under paragraph (c) of 5 173.77; or
(c) The vessel Is no longer
principally used in the State where the certificate was Issued.
(1) A valid certiflcat* of number or
temporary certiflcate for that vessel issued by the issuing authority In the
State in which the vessel is principally used; or
(2) For the vessel described In paragraph (b)
of this section, a copy of the, lease or rental agreement, signed by the owner
or his auUiorized representative and by the person leasing or renting the
TCGsel. tliat contains at least-(i) The vessel number that appears on the
certificate of number; and
(11) The
period of time for which the vessel Is leased or rented.
(b) Section 20(a) of the Act states In part:

Where the Coast Guard Issues numbers, the following classes of
vessels are exempt, under section 19 (a) of the Act, from the numbering
provisions of the Act and this part:
(a) A vessel Qiat to used exclusively for
racing.
(b) A vessel eautpped with
propulsion machinery of less than 10 horsepower that-
(1) Is owned by the owner of a vessel for
which a valid certificate of number has been Is-sued;
(2) Displays the number of that numbered
vessel followed by the iiUfHx "1" In the manner prescribed In 8 173.27; and
(3) Is used as a tender for direct
transportation between that vessel and the shore and for no other
purpose.
§
173.15 Vessel number rftqiiired.
(a) Except as provided in S 173.17, no person
may use a vessel to which this part applies unless-
(1) It has a number Issued on a certificate
of number by the Lssumg authority in the State In which the vessel is
principally used; and
(2) The
number is displayed as described In 9 173.27.
(b) This section does not apply to a vessel
for which a valid temporai-j- certificate has been Issued to Its owner by the
Issuing authority In the State In wliich the vessel is principally
used;

§ 173.3 Definitions.
As used
I n this part:
(a) "Act" means tiie Federal Boat Safety Act
of 1971 (85 Stat.
213; 46 U.S.a i451,etseq.).
(b) "Issuing authority" means a
State that has a numbering system approved by the Coast Guard or ttie Coast
Guard where a number system has not been approved. Issuing
authorities are listed in Appendix A of this part.
(c) "Operator*' means ttie person who is In
control or In charge of a vessel
vfhae it Is in use.
(d) "Owner" means a person who claims lawful
possession of a vessel by virtue of legal title or equitable
Interest therein which entitles him to such possession.
(e) "Person" means an Individual, firm,
partnership, corporation, company, association, joint-stock association, or
governmental entity and Includes a trustee, receiver, assignee, or similar
representative of any of them.
(f)
"Reporting authority" means a State that has a numbering system approved by the
Coast Guard or the Coast Guard where a numbering system has not
been approved. Reporting authorities are listed in Appendix A of this
part.
(g) "State" means a
State of the United. States, the Commonwealth of Puerto Rico, ttie
\^rgln Islands, Guam. Anierican Samoa, and the District of Columbia.
(h) "State of principal use" means the State
on whose waters a vessel is used or to be \ised most during
a calendar year.
(i)
"Use" means operate, navigate, or employ.
Subpart 8 -Numbering
§ 173.11 Applicahililr-
(1) subpart applies to each vessel equipped
with propulsion machinery of
any type used on waters subject to
the jurisdiction of the United States and on the high seas beyond the
territorial seas for vessels owned In the United States except-[BULLET]

Military or public vessels of the United States, except recreational-type
public vessels;
(c) A vessel whose
owner Is a State or subdivision tiiereor, which is lised principally for
governmental purposes, and which Is clearly Iderrtiflable as such;
(d) Ships' lifeboats;
(e) A vessel which has or is required to have
a valid marine document as a vessel of the United States.
(2) An engine air and fuel induction system
which provides adequate protection from propagation of bacltflre ilmne
to thti atinos])here equivalent to that provided by an approved
backfire flame arrester, A gasoline enjiine utiliiiintj an air nnd fuel
induction fiy;;l-ejn, and operated without an Approved backfire ilame arrc:,ter
shall Imvo such InElallalion tested and labeled in accordance with the
specifications contained in Eubijart 102.04:3 of Gubchapter Q {SpeciJications)
of this chapter and such system shall be speciflcally approved by
the Command-dant.
(3) Any
attachment to the carburetor or location of the ciDjinc air
indiietion system by means of which flames caused by engine backfire will be
dlsj)ersed to the atmosphere outsidt; the ves.sel in .such a manner that the
flames will not endanger the vessel, persons on board, or nearby vessels and
structures, AU attachments shall be of metallic con.struc-tion with flametight
connections, and firmly secured to withstand vibration, shock, and engine
backfire. Such Installations do not require formal apjiroval
and labeling, but will be acecpied by Coast Guard law enforcement oflicers on
the basis of compliance wltii this subpart.
(4) Where manufacturers wish to produce
vessels having an intetrrated engine-vessel design, a pre-niariiet ap!)rovaI of
an engine air induction system i.s available. Such an installation shall be
tested and labeled in accordance with the specifications contained in Subpart
162.043 of Subchapter Q (Specifications* of this chapter and such system shall
be specifically approved by the Commandant.

§ 25.40-1
Tanks ‹nd engine spaeca.
(a) All
motorboats or motor vessel.'!, ^ except open boats, the construction or decking
over of which is commenced after April 25, 1940, and which use fuel having a
flashpoint of 110° P. or less, shall have at least 2 ventilator ducts,
fitted with cowls or their equivalent, for the elEcient removal of explosive or
flammable eases fi-om the bilges of every engine and fuel tank compartnient.
Tliere shall be at least one exbau-t duct instafled so as to extend from the
open atmosphere to the hnvur pi.ut!on of the bilge and at lea.-^t one intake
duit la-
stalled so as to extend to a point at least midway to the bilge
or at least below the level of the carburetor air intake. The cowls shall be
located and trimmed for maximum effectiveness and In such a manner so as to
prevent displaced fumes from being recirculated.
(b) As used In this section, the term "open
boats" means those motorboats or motor vessels with all enr.ine and fuel tfink
compartments, and otlier spaces to which explosive or flammable gases and
vapors from these compartments may flow, open to the atmosjjherc and so
arranged ns to prevent the entrapment of such gases and vapors within the
vessel.
(c) Where alterations are
needed for existing motorboats or motor vessels to comply with the reauirements
In this section, such alterations sliall be accomplished as soon as practicable
but in any case shall be completed by June 1, 1966.
