TITLE: Adoption of Home Inspection Standards of Practice and Code of Ethics

The current Arkansas home inspector registration statute, Arkansas Code Title 17, Chapter 52, specifies standards of practice and code of ethics with which home inspectors practicing in Arkansas must comply. Whereas the Homes Inspector Advisory Board finds that when Title 17, Chapter 52 is replaced by the content of Act 1378 of the 2003 Arkansas Legislature on July 1, 2003 there will be no specified Standards of Practice or Code of Ethics for the home inspection industry. As result, an imminent peril to the public safety and welfare will exist at that time. However, Section 5 of Act 1328 specifies that current rules of this Board shall remain in effect until the Home Inspector Registration Board created by that Act adopts regulations. To protect the citizens of this state from such perils, the Homes Inspector Advisory Board, under emergency rule making provisions of the Arkansas Administrative Procedures Act 25-15-204(b) and (e), hereby adopt the Standards of Practice and Code of Ethics of the American Society of Home Inspectors (with an effective date of January 1, 2000) as the standards and Ethics for home inspectors in the state of Arkansas. All persons conducting home inspections for compensation in the state shall comply with those standards and that code of ethics.

The effective date of this rule shall be June 30, 2003.
