Fla. Admin. Code Ann. R. 14-96.016 - Maintenance of Connections and Traffic Control Devices
(1)
Maintenance of Connections.
(a) Rural Section.
Department maintenance shall extend to five feet from the edge of pavement
(including auxiliary lanes) or to the limits of paved shoulders. The remainder
of any paved or unpaved connection area on the right of way shall be maintained
by the owner or the authorized agent.
(b) Urban (Curb and Gutter) Section.
Department maintenance of pavement shall extend to the existing or maintained
right of way line or to the back of sidewalk, whichever distance is
less.
(c) Drainage. Control and
maintenance of drainage facilities within the right of way shall be solely the
responsibility of the Department, unless otherwise specified in the connection
permit.
(2) Maintenance
of Traffic Control Devices.
(a) The
maintenance and operation of highway lighting, traffic signals, associated
equipment, and other necessary devices shall be the responsibility of the
governmental entity having maintenance jurisdiction of the equipment or
devices. During the construction of connection(s), the permittee will be
responsible for the operation, repair, replacement, or provision of temporary
maintenance, if traffic control devices are impacted by the permittee's
operations.
(b) All pavement
markings on the State Highways System, including acceleration and deceleration
lane markings, and signing installed for the operation of the State Highway
System shall be maintained by the Department.
(c) All signing and markings required for the
operation of the connection (such as stop bars and stop signs for the
connection) shall be the responsibility of the property owner and current user
entity responsible for the connection, or governmental entity having
jurisdiction over the connection, road, or intersection of the state highway
regardless of the owner of the right of way as provided in Chapter 316,
F.S.
