Fla. Admin. Code Ann. R. 61A-3.048 - Exploitation of Dwarfs
(1) A dwarf is a
person with the medical condition known as dwarfism. Dwarfism means a person of
disproportionate or proportionate short stature most often caused by a genetic
syndrome.
(2) It is unlawful for a
licensee to promote, engage in, or permit any exploitative contest, promotion
or other form of recreational activity which results in the endangerment of the
health, safety or welfare of a dwarf on any premises licensed under the
beverage law. Any activity described as dwarf-tossing is specifically included
within those acts of exploitation prohibited by this rule.
(3) Nothing contained herein shall be
construed to prohibit dwarfs from engaging in non-exploitative sporting or
recreational events of the type engaged in by persons who are not
dwarfs.
(4) The division is
authorized to impose all the penalties set forth in Section
561.29 or
561.665, F.S., against the
license of any entity found in violation of this rule.
