Fla. Admin. Code Ann. R. 61B-45.015 - Parties; Appearances; Substitution and Withdrawal of Counsel
(1) Parties in proceedings before the
arbitrator are unit owners, associations, and tenants to the extent provided in
subsection 61B-45.013(5),
F.A.C. If the dispute involves a tenant, the tenant and the unit owner shall be
named as party respondents. If the petition may directly affect the particular
interests of a non-party unit owner, the unit owner shall be made a party to
the proceeding. Parties shall be entitled to receive copies of all pleadings,
motions, notices, orders and other matters filed in a proceeding. The party who
files a petition shall be designated as the petitioner. The party who files an
answer shall be designated as the respondent.
(2) Withdrawal of Counsel or Representative.
An attorney or qualified representative who has filed a petition or has
otherwise become an attorney or representative of record for any party to a
proceeding under these rules shall remain attorney or representative of record
in said cause and shall be permitted to withdraw from the cause only upon
filing a notice with the arbitrator, which notice shall provide a correct
mailing address for the client.
