Fla. Admin. Code Ann. R. 61B-50.106 - Computation of Time
(1) In computing
the five full business days prescribed by Sections
718.112(2)(j),
719.106(1)(f)
and 723.078(2)(i),
F.S., and these rules, the day of the act from which the period of time begins
to run shall not be included. The last day of the period shall be included
unless it is a Saturday, Sunday or legal holiday as prescribed by Section
110.117, F.S., in which event
the period shall run until the end of the next business day.
(2) Additional Time After Service By Mail.
Unless otherwise ordered by the arbitrator, during the pendency of a case, when
a party is required or permitted by these rules or by order of the arbitrator
to do an act within a prescribed period after the service of a paper upon that
party and the paper is served by regular United States mail, five days shall be
added to the prescribed period. This provision does not apply to the filing of
the petition for recall arbitration. No additional time shall be added to the
prescribed period if service is made by hand, facsimile transmission, or other
electronic transmission.
