Fla. Admin. Code Ann. R. 69O-194.007 - Advertising
(1) Advertising includes printed and
published material, descriptive literature and sales aids, sales talks and
sales materials, booklets, forms and pamphlets, illustrations, depictions and
form letters, and newspaper, radio, television and direct mail advertising, and
any other material prepared for dissemination to the public.
(2) Advertising must be truthful and not
misleading in fact or implication. Words or phrases shall not be used whose
meaning is unclear or whose understanding depends upon familiarity with
technical terminology.
(3) The
format and content of any PHC advertising shall be sufficiently complete and
clear so as not to be untrue, deceptive, or misleading. Whether an
advertisement has the capacity or tendency to mislead or deceive shall be based
on the overall impression which the advertisement may be reasonably expected to
create upon a person of average education and intelligence.
(4) All advertisements must clearly show or
state the name and address of the PHC as filed with the
Office.
