Ga. Comp. R. & Regs. R. 511-7-1-.09 - Notice Requirements
(1) Each Health Care Provider, prior to
providing Health Care, must provide written notice to each Patient, or to the
Patient's legal representative, receipt of which must be acknowledged in
writing on a form prescribed by the Department, that the Health Care Provider
is an agent of the Department and that the exclusive remedy for injury or
damage suffered as a result of any act or omission of the Health Care Provider
is by commencement of an action pursuant to the provisions of Article 2 of
Chapter 21 of Title 50 of the Official Code of Georgia Annotated.
(2) In the event that a Patient requires
Emergency Care, the form referenced in subsection (1) of this Rule must either
be signed by the Patient's legal representative, or if such person is
unavailable, the Patient must receive and execute the acknowledgment within
forty-eight hours after the Patient has the mental capacity to consent to the
Emergency Care. If the Patient or Patient's legal representative refuses to
consent to the Emergency Care after such care has been provided, the Department
may terminate the Patient's right to further participate in the
Program.
