Haw. Code R. § 11-160-26 - Primary caregiver requirements
To register with the department as the primary caregiver of a qualifying patient, a person shall:
(1) Be at least eighteen years of
age;
(2) Not be the qualifying
patient or the qualifying patient's physician;
(3) Agree to undertake responsibility for
managing the well-being of the qualifying patient with respect to the medical
use of cannabis;
(4) Be a parent,
guardian, or person having legal custody of the qualifying patient where the
qualifying patient is a minor or an adult lacking legal capacity;
(5) Be responsible for the care of only one
qualifying patient at any given time, unless the primary caregiver is the
parent, guardian, or person having legal custody of more than one minor
qualifying patient, in which case the primary caregiver may be responsible for
the care of more than one minor qualifying patient at any given time; provided
that the primary caregiver is the parent, guardian, or person having legal
custody of all of the primary caregiver's minor qualifying patients;
(6) Be the only primary caregiver for the
qualifying patient; provided that a minor qualifying patient may have two
primary caregivers only where both primary caregivers are the parent, guardian,
or person having legal custody of the minor qualifying patient; and
(7) Be designated by the qualifying patient
as the qualifying patient's primary caregiver.
