Haw. Code R. § 11-20-38 - Additives
(a) No supplier of water shall directly or
indirectly add any chemical, material, or product to the drinking water
supplied by a public water systems unless the chemical, material, or product
has been tested and certified as meeting the specifications of American
National Standards Institute/National Sanitation Foundation Standard 60,
Drinking Water Treatment Chemicals - Health Effects. This requirement shall be
met under testing conducted by a product certification organization accredited
for this purpose by the American National Standards Institute.
(b) A supplier of water may use a chemical,
material, or product that has not been certified as described in subsection (a)
if the director finds that the use will not pose an adverse risk to public
health and:
(1) There are no certified
alternatives available; or
(2) The
chemical, material, or product is in the process of being tested and certified
and there are no certified alternatives available.
(c) Prior to using an uncertified chemical,
material, or product the supplier of water shall submit to the director:
(1) A detailed explanation of the need for
the chemical, material, or product;
(2)
The date the chemical, material, or product was submitted for
testing;
(3) Where applicable, the
name of the accredited product certification organization conducting the
testing;
(4) A statement that
certified alternatives are not available; and
(5) Any other information deemed necessary by
the director.
(d) The
use of any chemical, material, or product in drinking water treatment or supply
shall conform to the manufacturer's instructions or recommendations for use,
maximum dosage, application rates, installation, restrictions, and any other
conditions imposed by the product certification organization accredited by the
American National Standards Institute or the director.
