Haw. Code R. § 11-453-35 - Trade Secrecy Claims
(a) Any person
asserting trade secrecy claims for chemical identity information collected
under this chapter shall follow the procedures established by the U.S.
Environmental Protection Agency described at title 40 Code of Federal
Regulations part 350 (Trade Secret Claims for Emergency Planning and Community
Right-to-Know Act Information: and Trade Secret Disclosures to Health
Professionals).
(b) A copy of the
redacted version of the documents, and a copy of page 1 of the accompanying
U.S. Environmental Protection Agency substantiation form, submitted to the U.S.
Environmental Protection Agency shall be submitted to the commission.
(c) Public petitions requesting disclosure of
chemical identity claimed as trade secret shall be made in accordance with
procedures described in title 40 Code of Federal Regulations section 350.15 and
350.16.
