Haw. Code R. § 11-504-46 - Suspension, revocation, and modification of accreditation
(a) The department may suspend, revoke, or
modify any training course accreditation after a hearing in accordance with
chapter 91, HRS, for:
(1) Failure to comply
with the applicable requirements, procedures, and standards;
(2) Misrepresentation of the extent of a
training course's approval by a state or the EPA;
(3) Failure to submit required information or
notifications in a timely manner;
(4) Failure to maintain requisite
records;
(5) Falsifications of
accreditation records, instructor qualifications, or other accreditation
information; or
(6) Failure to
adhere to the training standards and requirements of the EPA or chapter
504.
(b) The department
may also suspend or withdraw training course accreditation if an accredited
training course instructor or other person with supervisory authority over the
delivery of training has been found in violation of other asbestos rules
administered by the department. A finding of violation, or execution of a
consent agreement and order constitute evidence of a failure to comply with
relevant statutes, rules, and regulations.
