Haw. Code R. § 11-94.2-10 - Inspection
(a) All inspections and complaint
investigations shall be unannounced and may be conducted outside of normal
business hours of the State.
(b)
The department may conduct inspections and investigations of an exempt facility
regarding complaints, adverse accreditation or certification findings, or
periodic validation surveys.
(c)
Following an inspection, a statement of deficiencies, if any, shall be
presented to the facility. The facility shall return a plan of correction to
the department within ten days of the receipt of the statement of deficiencies.
Receipt of the statement of deficiencies is presumed to be within five days
from the date of the notice. Facilities shall be allowed a reasonable time to
implement the plan of correction. A follow-up inspection may be made by the
department to assess the progress in the plan of correction. If there has not
been substantial progress in carrying out the plan of correction, the license
shall be revoked or shall not be renewed. A provisional license may be issued
should the department determine that good faith efforts are being made by the
facility to carry out the plan of correction and the facility requires
additional time to meet the requirements.
(d) The department shall charge appropriate
fees for the processing of an application, issuance of a new license, and a
license renewal. The department shall provide prior notice of the amount of the
fee to the licensee.
