Haw. Code R. § 12-24-11 - Answer
(a) If the respondent files a written
verified answer, it shall be filed within twenty days from the date of personal
delivery or mailing of the complaint.
(b) The answer shall state the reasons or
factors for the suspension, discharge, or discrimination of the complainant,
and any matter which constitutes a defense to the complaint.
(c) The answer with two copies shall be filed
by personal delivery or by certified mail, return receipt requested, addressed
to the department's Wage Standards Division, 830 Punchbowl Street, Room 340,
Honolulu, Hawaii 96813, or to any of the department's district offices in the
counties of Hawaii, Maui, or Kauai in which the complaint was filed. The
respondent shall also mail a copy by certified mail, return receipt requested,
to the complainant at the last known address.
(d) The time within which the answer shall be
filed may be extended at the discretion of the hearing officer.
(e) The answer or any part thereof may be
amended prior to the hearing without the hearing officer's consent, and
thereafter at the discretion of the hearing officer. If a complaint has been
amended subsequent to the filing of the answer, the respondent shall have an
opportunity to amend the answer within twenty days after being served the
amended complaint. The original of the amended answer shall be filed at the
enforcement division of the department, and one copy shall be mailed to the
complainant by certified mail, return receipt requested, at the last known
address.
