Haw. Code R. § 12-25-54 - Occupations involved in excavation operations
(a) Except
as otherwise provided in this section, the following occupations in excavation
operations are declared hazardous for minors under eighteen years of age:
(1) Excavating, working in, or backfilling
(refilling) trenches, except:
(A) Manually
excavating or manually backfilling trenches that do not exceed four feet in
depth at any point; or
(B) Working
in trenches that do not exceed four feet in depth at any point;
(2) Excavating for buildings or
other structures or working in such excavations, except:
(A) Manually excavating to a depth not to
exceed four feet below any ground surface adjoining the excavation;
or
(B) Working in an excavation not
exceeding such depth; or
(C)
Working in an excavation where the side walls are shored or sloped to the angle
of repose as required by the occupational safety and health standards of the
department;
(3) Working
within tunnels prior to the completion of all driving and shoring operations;
and
(4) Working within shafts prior
to the completion of all sinking and shoring operations.
(b) This section shall not apply to the
employment of any apprentice, trainee, student-learner, or enrollee under
conditions prescribed in section 12-25-43.
