Haw. Code R. § 12-43-19 - Intervention
(a) A petition to intervene in a proceeding
and become a party thereto shall be filed with the board within ten days after
notice of the proceeding in which intervention is sought, or as otherwise
directed by the board.
(b) The
petition shall contain the following:
(1)
Nature and extent of the petitioner's rights or interest;
(2) Effect of any decision in the proceeding
on the petitioner's rights or interest;
(3) Extent to which the petitioner's interest
may be represented by existing parties;
(4) Extent to which the petitioner's
participation will broaden the issue or delay the proceeding; and
(5) Any other relevant facts.
(c) Intervention is discretionary,
and may only be granted on averments which are reasonably pertinent to the
issues already presented but do not unduly broaden them. If intervention is
granted, the petitioner thereby becomes an intervenor and a party to the
proceeding to the degree indicated by board order allowing the
intervention.
