Haw. Code R. § 12-51-21 - Informal conferences
At the request of an affected employer, employee, or their respective designated representative, the director may hold an informal conference for the purpose of discussing any issues raised by an inspection, citation, notice of proposed penalty, or notice of intention to contest.
(1) If the conference is requested by the
employer, an affected employee or their designated representative shall be
afforded an opportunity to participate, at the discretion of the
director.
(2) If the conference is
requested by an employee or their designated representative, the employer shall
be afforded an opportunity to participate, at the discretion of the
director.
(3) Any party may be
represented by counsel at the conference.
(4) No informal conference or request for an
informal conference shall operate as a stay of any twenty-day period for filing
a petition for appeal under section 12-51-19.
