Haw. Code R. § 12-57-3 - Unprotected activities distinguished
(a) The protected
activity must constitute a substantial reason for the discharge or other
adverse action, or
(b) The
discharge or other adverse action would not have taken place "but for"
engagement in the protected activity by the employee.
