Haw. Code R. § 13-130-1 - Purpose
(a) These rules provide guidance for the
conduct of the Na Ala Hele Advisory Councils; procedures for the selection and
inclusion of trails and accesses in the Hawaii statewide trail and access
system; and rules for the management and use of program trails and accesses.
These rules are not intended to diminish or abrogate the provisions of Article
12, Section 7 of the Hawaii State Constitution or Section
7-1,
Hawaii Revised Statutes relating to certain traditional and customary Hawaiian
practices.
(b) The trail and access
use rules are for the purpose of:
(1)
Preserving and perpetuating the integrity, condition, naturalness, and beauty
of the trails or accesses and surrounding areas;
(2) Protecting cultural and environmental
resources;
(3) Providing safety for
trail and access users;
(4)
Preserving the quality of the intended experience for trail and access
users;
(5) Mitigating conflicts
between competing activities and users;
(6) Ensuring public access consistent with
paragraphs (1)-(5); and
(7)
Regulating commercial activity that is consistent with paragraphs
(1)-(6).
