Haw. Code R. § 13-140-23 - Grant agreement

(a) County and nonprofit applicants that have been awarded land acquisition grant funds by the board and will hold title to the interest in land being acquired, must enter into a grant agreement with the board.
(b) Per the discretion of the board, a state agency that is awarded funds by the board may either:
(1) Acquire land under the authority of the board; or
(2) Enter into a grant agreement with the board if the state agency possesses legal authority to conduct land acquisitions.
(c) The grant agreement may contain provisions or attachments relating to the management and protection of the specific resource values for which an award was granted. The department may require awardee to supply evidence of the condition of these resources on the date of acquisition and to supplement thereafter.
