Haw. Code R. § 13-169-30 - Initiation by commission

(a) The commission may initiate proceedings for the establishment of an instream flow standard for any stream(s) or stream reach(es) in the state. In acting upon the establishment of instream flow standards, the commission shall set forth in writing its conclusion that the public interest requires an instream flow standard to be set, the reasons therefore, and the findings supporting the reasons.
(b) Instream flow standards shall be established on a stream-by-stream basis whenever necessary to protect the public interest in waters of the state.
