Haw. Code R. § 13-190.1-13 - Notice

(a) The board shall give notice to file an application for certificate of approval to impound to owners of dams or reservoirs known to the department, who have failed to file such applications as required by this chapter.

(b) The notice provided for in this section shall be delivered by certified mail to the owner at the owner's last address of record in the office of the county tax assessor for the county in which the dam or reservoir is located.

(c) Service of the notice shall be complete upon the mailing of the notice.

(d) All owners shall submit an application for certificate of approval to impound water within ninety days from the date of the notice, unless the owner has filed a request for exemption. An owner who fails to submit an application for certificate of approval to impound within ninety days from the date of notice shall be deemed in violation of these rules and subject to penalties consistent with sections 13-190.1-5 and 13-190.1-5.1.
