Haw. Code R. § 13-190.1-32 - Complaints as to unsafe conditions during construction
(a) Upon receipt of a written complaint
alleging that the person or property of the complainant is endangered by the
construction, enlargement, repairs, alterations, removal, maintenance, or
operation of any dam or reservoir, the department shall contact the owner and
the department or department representative shall conduct an inspection unless
the data, records, and inspection reports on file with the department are
sufficiently adequate to determine whether the complaint is valid or
invalid.
(b) If an unsafe condition
exists, the. department shall notify the owner to take action necessary to
render the condition safe, including breaching or removal of any dam found
beyond repair. If the owner is unavailable or unresponsive, the board may
commence action under section 13-190.1-41.
