Haw. Code R. § 13-256-19 - Parasailinq activities
(a) Parasailing
operators shall comply with rules and regulations promulgated by the U. S.
Coast Guard in addition to the following provisions:
(1) All parasailing vessels shall have access
to designated areas only from harbors or ramp facilities by the most direct
route consistent with safety considerations.
(2) No commercial parasailing vessel shall
operate on the waters of the State unless the owner has applied for and been
issued a commercial operating area use permit for a designated parasail
operating area, in addition to any commercial use permit required for
state-owned facilities.
(3) No
operator shall be issued more than one commercial operating area use permit for
a designated parasailing operating area.
(4) No permittee shall be allowed to operate
more than one parasail vessel with a parasail aloft in the designated
parasailing operating area.
(5) No
parasailing vessel shall be engaged in parasailing activities while it is
within three hundred feet of the shoreline or any marked channel
entrance.
(6) All parasail vessels
shall carry at least one crew member in addition to the captain whose duty it
shall be to observe the passenger in the chute.
(b) Parasailing operations shall be curtailed
in certain designated areas under this chapter as necessary to avoid possible
adverse impacts on humpback whales or other protected marine life. In
designated areas during the whale season, the maximum vessel speed for
parasailing shall be eighteen (18) knots, and maximum transit speed for
shuttling passengers to and from the parasailing zones shall be fifteen (15)
knots or minimum planing speed, whichever is less, unless governed by other
limits such as slow-no-wake zones or as marked by signs.
