Haw. Code R. § 13-256-32 - Commercial Operator Licensee experience requirements
(a) No commercial vessel operator shall be
issued a commercial operator permit to operate or navigate within the Na Pali
Coast ocean waters unless the applicant has a minimum of ninety days experience
operating within the Na Pali Coast ocean waters attested to by two persons each
of whom holds a valid commercial operator permit issued by the
department.
(b) No commercial kayak
tour guide license shall be issued a commercial operator licensee unless the
operator meets the following conditions:
(1)
Possesses a current Red Cross Advanced Life Saving Certificate,
(2) Has knowledge of elementary first
aid;
(3) Is physically qualified to
perform as a kayak tour guide as evidenced by a written report of a physical
examination made no earlier than thirty days prior to the application for the
license; and
(4) Demonstrates a
satisfactory knowledge of the waters through presentation of a log of ocean
kayak trips performed in the Na Pali Coast restricted area during the preceding
six-month period.
(c)
The department shall establish an advisory committee of not less than three
commercial operator licensees to review applications and make recommendations
for commercial operator licenses required by this section. The department may
seek recommendations for membership on the advisory committee from the North
Shore Charter Boat Association. Members of the advisory committee shall have
not less than three years experience in their area of specialty operating in
the North Shore Kauai Ocean Recreation Management Area.
