Haw. Code R. § 15-10-12 - Set-aside volume
(a) The SMC shall
notify each prime supplier of the monthly set-aside percentage, not to exceed
five per cent, applicable to each product subject to the set-aside program.
Prime suppliers shall be notified of set-aside percentages not later than
fifteen days prior to the beginning of each allocation month.
(b) The total set-aside volume available to
the SMC for any particular month shall be the sum of the amounts calculated by
multiplying the state set-aside percentage level by each prime supplier's
estimated supply for that month which will be sold into the state's
distribution system for consumption within Hawaii. The set-aside for a
particular month shall not be accumulated or deferred by the State, but shall
be made available from current monthly stocks of prime suppliers.
(c) The SMC shall confirm the set-aside
volume for a particular month from the supplier's monthly report (Form EIA 782C
which shall be received by the SMC not later than five working days prior to
the first day of the applicable month.
