Haw. Code R. § 15-217-64 - Conditional use of vacant land
(a) The executive
director may issue a conditional use of vacant land permit, provided that the
following standards are met:
(1) The proposed
use is permitted within the applicable zone except:
(A) Open or uncovered parking at grade may be
permitted in all zones, whether paved or unpaved; and
(B) Construction sites, special trade
construction, and non-extensive yard uses may be permitted in all zones where a
six-foot screening wall, hedge, or fence is erected along all street rights of
way;
(2) The maximum
duration of the use is for a two-year period, provided that the executive
director may issue extensions of up to two additional years if the development
status of the area has not changed appreciably since the use was initially
permitted;
(3) The floor area ratio
of any proposed temporary structure shall not exceed 0.5 and the project shall
conform to the built form and landscaping standards of the rules; and
(4) The proposed use shall in no way prevent
or delay the future development or improvements to the property.
(b) In addition to these
standards, the executive director may include additional requirements in the
permit to ensure that the conditional use does not adversely affect adjacent
property and the appearance of the mauka area.
