Haw. Code R. § 15-219-53 - Proposed decision and order; contested case
(a) Where a
decision is adverse to a party to the proceeding other than the authority
itself and:
(1) Not all of the members of the
authority-entitled to vote on any given matter have heard and examined all the
evidence; or
(2) A hearings officer
presided over the contested case hearing, the decision shall not be made until
a proposed decision and order is served upon all the parties and any party
adversely affected is afforded an opportunity to file exceptions and present
argument to the authority in accordance with section
91-11,
HRS.
(b) Any party which
files exceptions or submits written argument in support thereof shall do so
within twelve days of the service of the proposed decision and order, or within
such other time as may be designated by the presiding officer.
