Haw. Code R. § 15-35-9 - Request for an exemption
The petroleum commissioner may authorize the sale of gasoline that does not meet the requirement of ten per cent ethanol if the petroleum commissioner determines that
(1) Sufficient quantities of
competitively-priced ethanol are not available to meet the minimum requirements
of this chapter; or
(2) In the
event of any other circumstance for which the petroleum commissioner determines
compliance with this chapter would cause undue hardship.
