Haw. Code R. § 16-131-5 - Credit
Cable operators, in the extension of credit for service, shall:
(1) Make all credit
determinations on the basis of the applicant's individual credit record. The
cable operator shall not make any determination based on arbitrary
classifications unrelated to credit reliability such as socio-economic and
place of residence distinctions;
(2) Inform all applicants for service who
shall be required to place a deposit with the cable operator of the basis for
the requirement;
(3) Afford
applicants for service and subscribers the right to examine their credit
records and all other documents utilized in evaluating the applicant's credit
reliability and make corrections of misinformation utilized or contained
therein;
(4) Protect the
confidentiality of applications and credit records of subscribers and
applicants for service;
(5) Require
as a credit deposit no more than a sum equivalent to a month's charge for cable
communications service; and
(6)
Refund all of a subscriber's deposit for basic cable services within one year
of the date of deposit, provided that the subscriber has demonstrated a
satisfactory payment record.
