Haw. Code R. § 16-39-105 - Action on documents submitted to the commissioner; extension
(a) The commissioner shall accept or deny
documents submitted to the commissioner within forty-five calendar days after
the date the documents were submitted.
(b) An application for registration as a
brokerdealer, agent, investment adviser, or investment adviser representative
shall become effective at noon on the forty-fifth day after a completed
application is filed unless:
(1) Otherwise
provided by state or federal law; or
(2) An earlier effective date is specified by
rule or order.
(c) To be
complete, the document shall consist of the appropriate form described in
section 16-39104, together with any additional documents or information and
fees required under this chapter or chapter 485A, HRS, or requested by the
commissioner.
(d) The commissioner
shall notify an applicant within forty-five calendar days of an application
being received if the application is not complete and shall provide the
applicant a list of the documents, information, and fees that must be filed in
order to have the application deemed complete. An applicant shall have an
additional forty-five calendar days from the receipt of the commissioner's
letter within which to complete the pending document. If the document has not
been completed within this time, it may be denied by the commissioner pursuant
to section 485A-412, HRS, or be withdrawn
by the applicant.
