Haw. Code R. § 16-601-106 - Additional requirements for water and motor carriers
(a) In addition to the requirements in
section 16-601-105, if the transaction involves a certificate, permit, or
operative right of a water or motor carrier, the application shall show the
following data:
(1) The territory or points
served, the nature of the service, the effect of the transaction upon present
operations or rights, and a certification that a copy of the application was
served upon or mailed to each carrier association that represents common
carriers with whom the proposed service is likely to compete. An applicant's
certificate of service shall also name all other parties served; and
(2) Whether the seller is a party to any
through routes or joint rates or fares with any other carrier and whether
operation under the rights involved is presently being conducted. If there has
been any suspension or discontinuance of service during the preceding three
years, the application shall state the facts and circumstances
thereof.
(b) The
applicant shall serve copies to additional parties and within the times as may
be designated by the chairperson or hearings officer and shall file proof of
service with the commission.
