Haw. Code R. § 16-601-37 - Prehearing order
(a) Where a
prehearing conference is held, the commission or hearings officer shall enter a
prehearing order which recites the action taken at the conference, including:
(1) The amendments allowed to the
pleadings;
(2) The agreements made
by the parties as to any of the matters considered;
(3) The issues for hearing not otherwise
disposed of by admissions or agreements of the parties; and
(4) The procedural schedule.
(b) The prehearing order shall
control the subsequent course of the hearing, unless modified by the commission
or hearings officer at the hearing to prevent manifest injustice. The
prehearing order shall supersede the pleadings where there is any conflict and
shall supplement the pleadings in all other respects.
