Haw. Code R. § 17-1722-125 - Termination
(a) An individual's participation under this
program shall be terminated for any of the following reasons:
(1) Fails to meet the eligibility
requirements set forth in section 17-1722-119.
(2) The participant voluntarily terminates
participation in the program;
(3)
The participant failed to recertify;
(4) The participant failed to cooperate with
the quality control reviewer;
(5)
Death of the participating individual; or
(6) There are insufficient funds in the state
pharmacy assistance program special fund.
(7) Death of the participating individual;
or
(8) There is insufficient funds
in the program due to lack of revenues received from rebates paid by
pharmaceutical manufacturers.
(b) An individual shall be given a ten day
advance notice of termination. The notice must specify the effective date of
termination, the reason for termination, and procedures to appeal the
termination.
(c) If an appeal is
requested prior to the effective date of termination, the termination shall be
stayed pending the outcome of the appeal, provided the individual otherwise
remains eligible.
