Haw. Code R. § 17-655-3 - Right to assistance
(a) The department
shall provide Aid to Families with Dependent Children, Aid to the Aged, Blind
and Disabled and food stamp assistance to any individual or family who meets
all of the eligibility conditions set forth by the rules of the
department.
(b) The department
shall provide general assistance to any individual or couple who meets all of
the eligibility conditions set forth by the rules of the department if funding
is available.
(c) The department
shall not provide assistance to any individual or family who fails to provide
verification of all eligibility conditions or fails to meet all the conditions
of eligibility set forth by the rules of the department.
(d) Persons who are eligible for or receiving
financial assistance from the department shall receive medical assistance,
unless determined ineligible for medicaid coverage due to the individual or
family's failure to comply with a medicaid requirement.
(e) The department shall not provide
financial assistance to any applicant or recipient who is:
(1) Found guilty of fraudently
misrepresenting residence to obtain assistance in two or more states. The
penalty period shall be ten years from the date of conviction; or
(2) A fugitive felon; or
(3) In violation of a condition of probation
or parole; or
(4) Convicted after
August 22, 1996 of a felony offense for possession, use, or distribution of
drugs and has refused treatment or has failed to comply with a treatment
program.
