Haw. Code R. § 17-681-2 - General requirements
(a) An individual
shall receive financial assistance under one financial assistance
program.
(b) An individual may be a
non-needy payee in another financial assistance case.
(c) Financial assistance paid by the
department shall not be subject to assignment, garnishment, or
attachment.
(d) Financial
assistance benefits shall be repaid to the department when:
(1) State loans are provided to applicants of
SSI under subchapter 4 who are approved for SSI;
(2) Real property liens are obtained under
chapter 17-675;
(3) Overpayments
occur and are collectible under chapters 17-606 and 17-683; or
(4) Claims are filed against the estate of a
former recipient under chapter 17-605.
(e) The department shall not direct the
manner in which the applicant or recipient plans, budgets or spends the
financial assistance benefit except in cases of money mismanagement or
sanctions in which a protective payee is designated.
