Haw. Code R. § 17-683-3 - Underpayments
(a) Prompt action shall be taken to correct
any underpayments to currently eligible assistance units and to assistance
units which would have been eligible if an error had not occurred.
(b) If an assistance unit has both an
overpayment and an underpayment, the overpayment and underpayment shall be
offset one against the other in correcting the payment.
(c) Payments provided to the assistance unit
to correct the underpayment shall not be counted as income or asset in
determining continued eligibility and the amount of assistance in the month the
corrective payment is made and the following month.
(d) Corrective payments shall be made for any
underpayment due a former recipient when financial assistance is
restored.
(e) The rules specified
in this section are effective for underpayments which are identified subsequent
to:
(1) September 30, 1981, for the federally
funded categories of assistance, regardless of when the underpayment occurred;
and
(2) July 18, 1982, for the
state funded categories of assistance, regardless of when the underpayment
occurred.
