Haw. Code R. § 17-798.3-5 - Scope
(a) Child care payments shall be for child
care services that include, but are not limited to:
(1) Supervision to assure the child's safety,
comfort, and health;
(2) Personal
care as appropriate to the child's age and developmental maturity;
(3) Activities appropriate to the child's
age, developmental stage, and degree of physical or mental ability;
(4) Health and nutritional services; and
(5) Provision of child care by
providers as defined in section 17-798.3-2.
(b) Child care payments shall not be allowed
for educational services including, but not limited to:
(1) Services provided to a child enrolled in
or eligible for public education in kindergarten to twelfth grade during the
regular school day, unless the child is out of school due to illness;
(2) Services for which a child receives
academic credit toward graduation;
(3) Any instructional services that supplant
or duplicate the academic program of any public or private school that is
established for the purpose of compliance with the school attendance law of
Hawaii; or
(4) Services that
provide specialized training or skill development to children, as indicated in
section
346-152(a)(4),
HRS.
(c) Child care
payments shall only be used services described in subsection (a)
