Haw. Code R. § 17-798.3-89 - Background checks for exempt providers
(a) All exempt
providers, any adult household members, regardless of whether they provide
care, and current or prospective staff, including volunteers, shall be subject
to and in compliance with chapter 17-801, prior to authorization of any child
care subsidy payments, and annually thereafter in accordance with chapter
17-801, to ensure that they are of reputable and responsible character, are
suitable to provide child care, and do not pose a risk to children in
care.
(b) The department shall deny
authorization for child care subsidy payment assistance to the family if the
exempt provider, household member, or current or prospective staff are
determined by the department to be not suitable to provide child care pursuant
to chapter 17-801.
(c) The
department shall deny child care subsidy payment assistance to the family using
an exempt provider who does not comply with the request to exclude a staff or
household member who is determined by the department to be not suitable to
provide child care in accordance with chapter 17-801.
(d) A person who cannot be authorized to
provide care for a family receiving child care subsidy payment assistance as a
result of the background check done pursuant to chapter 17-801 may request an
administrative hearing as provided in chapter 17-801."
