Haw. Code R. § 17-891.2-80 - Building codes and space requirements
Child care facilities shall conform to the zoning, building, electrical, and plumbing codes of the county in which the facility is located, to state rules as may be applicable to the facility, and the following:
(1) The department shall be
notified of changes or renovations in the home;
(2) Space requirements shall be as follows:
(A) For daytime care, there shall be a
minimum of thirty-five square feet of indoor area per child, excluding
bathrooms, closets, and hallways. Covered lanai area may be counted for not
more than thirty per cent of the required area;
(B) For nighttime care, each room used for
sleeping purposes for children in care shall have a minimum of fifty square
feet per child, excluding kitchen, bathroom, closets, hallways, and lanai
area;
(C) For outdoor space, there
shall be easy accessibility to adequate outdoor space and in all cases, a
minimum of one hundred fifty square feet. For children twelve months or older
there shall be a minimum of seventy-five square feet per
child;
(3) All parts of
the building, building appurtenances, outdoor space, equipment, and all other
parts of the facility shall be kept repaired, safe, and sanitary at all times;
and
(4) There shall be written
evidence that the condominium or townhome association allows the applicant to
operate a family child care home.
