Haw. Code R. § 19-122-29 - Application for hazardous materials endorsement
Every commercial driver who applies for, renews, or transfers a hazardous material endorsement shall:
(1) Provide proof of citizenship or
immigration status as specified in "List of Acceptable Documents for a Real ID
Compliant (Star) Hawaii Driver's License, Instruction Permit, Provisional
Driver's License or Hawaii State Identification Card" located on the DOT MVSO
Library web site. A lawful permanent resident of the United States must
additionally provide his or her Bureau of Citizenship and Immigration Services
(BCIS) Alien registration number. Only original documents or certified copies
of originals are acceptable.
(2)
Submit to a fingerprint-based background check in accordance with the rules
issued by the Transportation Security Administration under the Uniting and
Strengthening America by Providing Appropriate Tools Required to Intercept and
Obstruct Terrorism Act (USA PATRIOT Act), Act of 2001, P.L. No. 107-56, October
26, 2001. The examiner of drivers shall not issue a hazardous materials
endorsement until the State receives a notification of no security threat, the
applicant presents a valid Transportation Worker Identification Credential
(TWIC) or a grant of waiver for the applicant from the Transportation Security
Administration of the United States Department of Homeland Security, and the
applicant passes the hazardous materials test described in section
19-122-10.
