Haw. Code R. § 19-42-21 - Priorities for berths and moorings
The department shall allocate small craft and smaller commercial vessel berths and moorings in state commercial harbors in order to promote the maximum safe, convenient, and efficient utilization of the facilities, in the following priorities:
(1) Kewalo Basin
(A) Public Utilities Commission licensed
operators.
(B) Charter or cruise
boats have priority in the assignment of berths along the front of Kewalo Basin
paralleling Ala Moana Boulevard and all berths at Pier A.
(C) Commercial fishing boats have priority in
the assignment of all other berths in Kewalo Basin. If any of these berths are
empty, and if there are no commercial fishing boats on the waiting list,
charter, cruise or other commercial boats may be given a temporary mooring in
these berths; however, charter or cruise boats with temporary mooring permits
will be displaced by commercial fishing boats applying for regular mooring
permits.
(2) Designated
facilities for small craft and smaller commercial vessels in other state
commercial harbors.
(A) First priority:
Public Utilities Commission licensed operators.
(B) Second priority: commercial fishing
boats.
(C) Third priority: charter
or cruise boats.
(D) Fourth
priority: other commercial boats.
(E) Fifth priority: recreational small
craft.
(3) Exceptions to
the above priorities may be made when determined by the director to be in the
interest of public safety, health, and welfare.
