Haw. Code R. § 20-26-3 - Applicability and implementation, generally
(a) These rules
shall apply to all public activities and commercial activities in the UH
management areas as defined in these rules.
(b) These rules do not apply to education and
research activities and support functions carried out by:
(1) The university;
(2) Persons under an agreement with the
university; or
(3) Government
entities under an agreement with the university.
(c) Where overlapping jurisdictions within UH
management areas are present, including but not limited to department of land
and natural resources administrative rules pertaining to conservation
districts, forest reserves, historic preservation, hunting, and natural area
reserves, those rules shall govern.
(d) This chapter shall be implemented in
consultation with the department of land and natural resources, to allow
hunting and recreation in those areas designated by the department of land and
natural resources as regulated by department of land and natural resources
hunting rules.
(e) The president
may seek the advice of the Maunakea management board and the Kahu Ku Mauna
pursuant to the comprehensive management plan and consistent with the timelines
and procedures of this chapter,
(f)
Native Hawaiian traditional and customary rights as recognized and protected
under article XII, section 7, of the Hawaii State Constitution shall not be
abridged.
