Haw. Code R. § 20-26-62 - Research permits
(a) Research
permits may be issued to engage in activities for scientific, educational, or
management purposes, that may otherwise be prohibited by this
chapter.
(b) Applications for
research permits shall adequately describe the planned research activity,
including but not limited to the scope, duration, and location of the research
and shall be submitted at least one hundred twenty (120) calendar days in
advance of the date the permit is to be in effect.
(c) Applications for research permits shall
be evaluated for duplication with existing or previously approved research, for
compatibility with the functions and purpose of the UH management areas, for
consistency with existing approved management plans; for the potential effect
on the surrounding resources, the existing facilities, and the public's use of
the UH management areas; for compatibility with existing approved uses; and for
the applicant's prior record of non-compliance with permit conditions, or of
violations. Additional information may be required from the applicant to make
this evaluation. Failure to provide additional information when requested may
be grounds for permit denial.
(d)
Fees shall be assessed in accordance with section 20-26-6, and additional terms
and conditions necessary to protect the resources of the UH management areas
and to protect safety and welfare may be imposed.
