Haw. Code R. § 21-5-2.1 - Charges initiated by a member of the public
(a) Any individual
may file a charge with the commission. All charges shall contain a short and
simple statement of the facts constituting the alleged violation, the name of the
respondent, and the name and contact information of the individual filing the
charge. The charge shall be signed by the person making the charge under oath,
declaring under penalty of perjury that the allegations are true and correct to
the best of the person's knowledge. The executive director may investigate such
charges pursuant to section
21-5-1.5.
(b) Where it appears that a document submitted
to the commission is intended to be a charge, but the document does not comply
with subsection (a), the commission shall notify the filer of the insufficiency.
The executive director may investigate the matter in accordance with section
21-5-2 but shall not treat the
document as a charge until the insufficiency is corrected.
