Haw. Code R. § 21-5-6.5 - Motions
(a) All motions other than those made during a
hearing shall be made in writing, shall state the relief sought, and shall be
accompanied by an affidavit, or declaration, or memorandum setting forth the
grounds upon which the motions are based. The presiding officer shall set the
time for filing all motions and opposing memoranda, if any.
(b) Copies of all motions, affidavits,
declarations, and memoranda shall be served on all other parties to the hearing
within the time set by the presiding officer. The original shall be filed with
the commission with a certificate of service.
(c) Failure to serve or file an affidavit,
declaration, or memorandum in opposition to a motion or failure to appear at the
hearing on the motion, if held, shall be deemed a waiver of objection to the
granting or denying of the motion unless otherwise ordered by the
commission.
