Haw. Code R. § 4-66-46 - Experimental use permits; prohibitions
No permits shall be issued for any of the following:
(1) A product containing an active or inert
ingredient that is currently subject to an EPA cancellation or suspension of
registration order, or that is currently subject to an EPA notice of intent to
suspend or cancel registration because of human health, environmental, or
efficacy consideration; except that a permit may be issued for such a product
for a purpose or in a formulation that:
(A)
Is not specifically considered in, or that is not subject to, suspension or
cancellation proceedings, after consultation with appropriate EPA officials;
or
(B) Was specifically considered
during the proceedings but not suspended, canceled, or subject to a notice of
intent to suspend or cancel.
(2) A use of a product that has been the
subject of a notice of denial of registration under FIFRA; and
(3) A use of a product, which may involve use
in or on food or feed other than as authorized in section 4-66-47.
