Haw. Code R. § 4-71A-23 - List of select human pathogens
(a) The list of
microorganisms designated as select human pathogens, dated October 25, 2001, is
located at the end of this chapter and made a part of this section.
(b) The introduction into Hawaii and
possession of a microorganism on the list of select human pathogens is allowed
without permit issued by the department subject to branch approval for the
import in advance of shipment, and satisfaction of pre-entry and inspection
requirements and further provided that:
(1)
The importer submits to the chief in advance of shipment a valid certificate
issued by the CDC, for the movement of a species cited in Appendix A of the CDC
List of Select Agents at 42 United States Code of Federal Regulations, section
72.6; or
(2) The importer is a
clinical laboratory certified under the Clinical Laboratory Improvement
Amendments of 1988, (42 United States Code of Federal Regulations, section
263a) that utilizes microorganisms on the list of select human pathogens for
diagnostic, reference, verification, or proficiency testing purposes and is
exempt from 42 United States Code of Federal Regulations, section
72.6.
(c) The branch
shall notify the department of health of the entry into the State of the
microorganism for the purpose of possible inspection and monitoring by the
department of health.
