Haw. Code R. § 5-31-27 - Identifying arrearages and initiating enforcement
(a) The
agency shall maintain a system for identifying title IV-D cases in which there
is a failure to make payments in accordance with the child support
order.
(b) Upon identifying
arrearages or receiving a request for enforcement from other states, the agency
shall proceed to take appropriate enforcement action to collect child support
as currently ordered, within timeframes prescribed by federal regulations,
45 C.F.R.
§303.6(c)(2) and
(3).
(c) Upon identifying arrearages in a title
IV-D case where the non-custodial parent resides in another state, the title
IV-D agency in the other state shall be requested to provide enforcement
services when appropriate. The request shall be made as prescribed by federal
regulation,
45 C.F.R.
§303.7(b).
(d) Information maintained in computerized
systems available to the agency shall be adequate basis to identify an obligor
as owing arrearages or to impose enforcement.
